Free speech does not cover abusing the PM: Allahabad HC

An FIR has been refused to be quashed by the High Court of Allahabad that was registered against Mumtaz Mansoori of Jaunpur. The Court observed, “the Constitution recognizes freedom of speech but this right does not extend to hurling abuses against the PM and other Ministers.”

Jaunpur’s Mumtaz Mansoori was booked for making derogatory remarks against the PM, Home Minister, and other ministers on social media.

In the FIR registered in 2020, it was alleged that derogatory remarks were made by Mansoori against PM Modi, Amit Shah and other Union Ministers. Mansoori had been booked under IPC Section 504 (intentional insult with intent to provoke breach of peace) and Section 67 of IT Act (punishment for publishing or transmitting obscene material in electronic form).
