Nobody has the fundamental right to public holiday: HC

The Bombay High Court has observed that there are way too many public holidays in the country and it was time to reduce it for which the Bombay HC has recently rejected a petition filed by a resident of Dadra and Nagar Haveli so as to declare August 2 as a public holiday in the Union Territory because it was liberated on this day from the Portuguese rule and was being observed till 2020.

While the bench was rejecting the plea, it also held that there was “no legally enforceable fundamental right to a public holiday and whether or not to declare a particular day as a public holiday or optional holiday is a matter of government policy.”

The division bench consisted of Justice Gautam Patel and Justice Madhav Jamdar who were hearing the petition of Kishnabhai Ghutai and were informed by the advocates Bhavesh Parmar and Devmani Shukla that the day was being observed as the liberation day but is discontinued since July 29, 2021.
