Bombay HC: PIL dismissed to seek ban on advertisements of non-veg food

Chief Justice Dipankar Datta and Justice Madhav Jamdar were hearing a PIL by three Jain religious trusts along with a businessman Jyotindra Shah who were seeking a ban on the advertisements of non-vegetarian food items. They claimed that the advertisements are in violation of their right to life, to live in peace and privacy.

Chief Justice Dipankar Datta and Justice Madhav Jamdar said, “Why are you seeking to encroach on others’ rights?” 

The three trusts were Shree Trustee Atma Kamal Labdhisurishwarji Jain Gyanmandir Trust, Seth Motisha Religious and Charitable trust, Shri Vardhaman Parivar, and lastly, businessman Jyotindra Shah were seeking the Centre and state to bring out rules/guidelines/order to ban advertisements that show non-veg food in forms of print, electronic media, and internet, for which the court said, “Is it within our jurisdiction?…This is a legislative function and the HC being an organ of the State cannot say what legislation must be passed. It is for the legislators to decide. We will only interfere if an individual’s right is infringed.”
