The Allahabad High Court recently granted bail to an accused in a murder case, emphasizing that prolonged incarceration without a foreseeable trial conclusion violates the fundamental right to a speedy trial under Article 21 of the Constitution. The court’s decision highlights the importance of balancing individual liberty with the need for a fair trial.

The FIR was lodged on July 8, 2022, at Police Station Kotwali, District Budaun, under Sections 302, 504, and 506 IPC. The prosecution alleged that the applicant, Shahrukh and Rinku, along with two co-accused, had an altercation with the informant’s son over past enmity. Shahrukh was accused of shooting the deceased from behind, while the co-accused fired as well. The deceased died on the spot from gunshot injuries.

Hon’ble Justice Sanjay Kumar Singh observed that despite the gravity of the charges, liberty under Article 21 cannot be sacrificed when the trial shows no signs of early conclusion. The Court emphasized the right to bail over long pre-trial detention, particularly when delay is not attributable to the accused.

The Court allowed the bail application with the following direction: “Let applicant Shahrukh and Rinku be released on bail in Case Crime No. 446 of 2022 on his furnishing a personal bond and two sureties subject to the condition that he shall not tamper with evidence or influence witnesses.

Further, the Court warned In case of breach of any condition, the prosecution shall be at liberty to move for cancellation of bail.

Implications:

Strengthening Right to Speedy Trial: The ruling reinforces the judiciary’s responsibility to prevent indefinite undertrial detention and ensures that delays in trial cannot justify continued imprisonment.

Shift in Bail Jurisprudence: The decision underscores that bail should be granted when trial delays become excessive, even in serious cases.

Judicial Oversight: The judgment serves as a warning to trial courts and prosecuting agencies to ensure timely proceedings and prevent unnecessary delay.

The Allahabad High Court’s decision to grant bail in the murder case underscores the judiciary’s commitment to upholding the fundamental right to a speedy trial. By recognizing that prolonged incarceration without a foreseeable trial conclusion is unjust, the court has reaffirmed the importance of balancing individual liberty with the pursuit of justice. This ruling serves as a significant reminder of the need for efficient and timely trial proceedings, ensuring that justice is not delayed or denied due to systemic inefficiencies.
