Mumbai: An order issued by Mumbai Police Commissioner Sanjay Pandey stating that FIRs could be registered against police officers who do not file FIRs when an individual approaches them with a complaint. The order was issued last month. In order to record fewer crime incidents under their jurisdiction, officers do not register FIRs when people approach them with complaints, several such instances have been reported.
Under Section 166 C of the Indian Penal Code an FIR can be registered against police officers for not registering FIRs, said an officer regarding the order issued by the commissioner. According to the Act, in relation to the cognizable offence, if a public servant fails to record any information given to them shall be punished with rigorous imprisonment for a term that should not be less than six months and may extend to two years, under sub-section (1) of section of the Code of Criminal Procedure reported The Indian Express.
The officer further said that according to the order if a complaint regarding non-registration of FIR approached the Commissioner then the Commissioner will look into the complaint. If it is found out by senior officials that FIR was not registered for cognizable offence, an FIR will be registered in the case and in addition, another FIR will be registered against the concerned police officer who did not register the FIR.
Commissioner Pandey has shared his mobile number with the public, said the officer. He also received several complaints about the police not registering FIRs. The officer further said that after sharing his contact number, the Commissioner issued the order to ensure the people do not have run from pillar to post to get an FIR registered.
