Friday was a good hearing for the High Court of Kerala as the Court observed the very crucial topic of Marital Rape and Divorce.
The Kerala Court was hearing an appeal moved by a husband against a family court judgement that allowed, on grounds of cruelty, a divorce petition moved by his wife.
The Kerala High Court, after the case, observed that marital rape was a valid reason to seek divorce, Live Law reported.
The High Court noted that in modern social jurisprudence, a husband cannot claim supremacy on the body or individual status of the wife.
Marriage and Divorce coming under the same law is the current need, observed the court. The bench comprised of Justices A Muhamed Mustaque and Dr Kauser Edappagath who said there cannot be any difficulty in having a common code of law for all communities at least for marriage and divorce.
