Actor Kangana Ranaut has approached the Supreme Court to file a ‘Caveat’ in the Demolition case against Brihanmumbai Municipal Corporation (BMC). In her application to the Supreme Court, she asked the apex court ‘To Not Pass Any Order Without Hearing Her Side Of The Case.’ This is a precautionary move in case the BMC challenges the High Court’s decision and moves to the Apex Court.

What is a Caveat Case?

Caveat is a Notice given by a person, informing the Court that another person may file a suit or application against him and that the Court must give the Caveator (person filing the Caveat) a fair hearing before deciding any matter brought before it in the relevant case.

On Friday, a division bench of the Bombay Hight Court rejected a September 9 order issued by the Brihanmumbai Municipal Corporation’s order to demolish several unauthorized alterations made by actor Kangana Ranaut at her Pali Hill bungalow in Bandra (West).

The Bombay Hight Court, on November 27, announced its decision in favor of Kangana Ranaut with her fight against the BMC for demolishing her property on September 9, in Mumbai. The High Court said that a valuer will be appointed to determine damages caused to the actor due to the demolishing of her property. “The valuer will submit a report to the court and then, an order will be passed on compensation to Kangana Ranaut,” said the High Court.

The bench, that included SJ Kathawalla and Riyaz Chagla, said that the actor is justified in claiming damages in view of the law laid down by the Supreme Court in the Sunbeam Hightech Developers case. The court hence said that it can grant compensation to the demolished property, that was demolished illegally even when the structure on the property was unauthorized.

The High Court also warned the actress to show restrain while commenting on other people (even the government) on social media and otherwise.

The warning was issued on basis of the comment that Ms. Ranaut passed on Maharashtra’s ruling party, Shiv Sena, saying that it controls the BMC and the demolition was as revenge for her comments.
