“Every child has Right to use Mother’s Surname” – Delhi High Court

The Delhi High Court gave out a statement while seeing a case on Friday. The Court observed that every child has the right to use their mother’s surname and the father does not have the right to force his decision on the matter. 

The plea moved by the man seeking directions to authorities concerned to use his last name on official records as his minor daughter’s surname and not use her mother’s was the case that was in the Delhi HC.

The plea of the man mentioned that his estranged wife had changed the minor’s surname from “Srivastava” to “Saxena”. Adding in, the plea also mentioned that this will lead to a difficulty in availing insurance claims as the policy was taken in the name of the girl with her father’s last name.

After the complete hearing, the Court disposed of the petition as being without any merit. However, liberty was granted to the man for approaching the school of his daughter in order to show his name as her father.
