On Saturday, November 20, the Allahabad HC lowered the penalty that was imposed by the Special Sessions Court on Sonu Kushwaha (convict) who was found guilty of conducting oral sex with a 10-year-old minor child.

The single-judge bench of Justice Anil Kumar Ojha has reduced Sonu Kushwaha’s punishment from 10 to 7 years stating that the crime committed by him is “LESS SERIOUS”

On Saturday, the Allahabad HC has observed that inserting a penis inside a child’s mouth is punishable as “penetrative sexual assault’ under Section 4 of the POCSO Act. It is not an “aggravated penetrative sexual assault” or an “aggravated sexual assault” under Section 6 and 10 of the POCSO Act.
