Section 50(1) CrPC provides, “every police officer or other person arresting any person without a warrant shall forthwith communicate to him full particulars of the offense for which he is arrested or other grounds for such arrest.” In a nutshell, an accused can ask for an issued arrest warrant from the police officials before the further legal proceedings.
However what comes as a revolution in the vigilante forces is that the Yogi Adityanath government on Sunday issued a proclamation for the formation of the Uttar Pradesh Special Security Force (UPSSF), which will not require warrants for an arrest or to conduct searches as long as it is “sure about the crime”. The special force will be obligatory for the surveillance of important government buildings, offices and industrial establishments in the state, while private companies can also hire its services.
Chief Minister Yogi Aditynath announced the formation of the force on 26th June which was further passed by the state cabinet. “The UPSSF has got a nod from DGP of the state. This force will be deployed at places like metro rail, airports, industrial institutions, courts, religious places, banks, and other financial institutions,” Avaneesh Awasthi Additional Chief Secretary (Home) said. He further added “The headquarters of the UPSSF will be in Lucknow and an ADG-level officer will head the force. Initially, five battalions of UPSSF will be formed.” As per Mr.Awasthi’s statement, as many as 9,919 personnel will be deployed with the force within three months in the first phase, following which 1,913 posts will be created later.
As per the UP government, raising the five battalions will initially cost Rs 1747.06 crore. The force is being constituted on the lines of the Central Industrial Security Force (CISF).
The move is believed to be taken owing to the recent incidents of violence being reported on the premises of courts in recent years.
For the unversed, as of December 2019, three assailants opened fire in the court of Bijnoir chief judicial magistrate, killing a murder accused and wounded three others, a court employee, and two police officials. An analogous incident was witnessed in 2015 when an armed man entered the Muzaffarnagar courtroom in the facade of a lawyer and shot Vicky Tyagi: an alleged gangster.

Currently, the new move of launching a special police personnel force is receiving mixed reactions where some people are seen commending the move whereas others are doubting whether it will do more harm than good.
