States too can define minority status: Centre

An affidavit has been filed in the Supreme Court wherein the Union Ministry of Minority Affairs has said “state governments can also declare a religious or linguistic community as a ‘minority community’ within the state.”

The filing of this was done in a response to a 2020 petition which was done by advocate Ashwini Upadhyay saying that as per the census of 2011, Hindus were a minority in places like Lakshadweep, Mizoram, Nagaland, Meghalaya, J&K, Arunachal Pradesh, Punjab and Manipur and that minority status must be given to them in accordance with the laid down principle by the top court in 2002 TMA Pai ruling. 

In 1993, the Centre, under Section 2(c) of the National Commission for Minorities Act, 1992, had notified the Muslims, Sikhs, Buddhists, Parsis and Christians as minorities.
