On Tuesday, the Supreme Court upheld an Allahabad high court order from 2014, ordering the demolition of twin towers in the group’s Noida-based housing project Emerald Court. In its decision, the Supreme Court stated that the construction of the two towers, totalling 1000 flats, was illegal. A two-judge bench of the Supreme Court, comprised of Justice DY Chandrachud and Justice MR Shah, during the previous hearing, pulled up the Noida Authority for its “shocking use of power” in sanctioning the structures, concluded in its final judgement that their construction was the result of “collusion” between Authority officials and Supertech.
In the most recent hearing, on August 5, the bench reserved its decision to demolish the Apex and Ceyane towers.
The Supreme Court stated in its final order that the demolition should be completed within two months and that Supertech must carry out the work at its own expense. In addition, each flat owner will be required to pay a reimbursement with a 12% interest rate.
