The Bombay High Court foisted a fine of Rs 25 lakh on a company for a vexatious and mischievous proceeding that unnecessarily wasted the court’s time. Justice Patel said, “I can think of no reason to withhold an order of costs against the plaintiffs. The quantum of costs cannot be trivial.” For the moment of, Justice Patel noted that laws are in place as a disincentive to prevent parties from making such flippant applications. The law allows imposing heavy costs to make sure that parties understand that, courts are not playgrounds, and legal action is not a pastime, he said. The decision to impose a fine was taken by the Bombay High Court when a bench was hearing a suit filed by La Fin Financial Services Pvt Ltd against Multi Commodity Exchange Of India Ltd (MCX). During the hearing of the case, Justice Patel said the fine of Rs 25 lakh should be paid within two weeks.
