Alleged Pakistani terrorist Mohammad Naveed has agreed to give a confessional statement before a magistrate, in what is a major breakthrough for the National Investigation Agency probing the Udhampur attack, sources said.<\/p>\n
The statement will be recorded under section 164 of the Criminal Procedure Code (CrPC) making it admissible as an evidence before a court during trial. Statements made before the police are not admissible as evidence in court.<\/p>\n
\u201cNow a magistrate will be assigned for recording Naveed\u2019s statement. The magistrate will give him 24 hours to contemplate on making a statement. Once he agrees again, the magistrate will record Naveed\u2019s statement in his own handwriting,\u201d said an investigator.<\/p>\n
After Naveed agreed to give a confessional statement before a magistrate, a court in Jammu sent him to judicial custody till August 26.<\/p>\n
\u201cUnder the law, Naveed can be held on police remand for 30 days. We have exhausted 15 days of police custody so far. We may like to interrogate him at a later state if we manage to catch one of his associates who crossed the Indo-Pak border along with him to carry out the suicide attack on the BSF bus,\u201d the investigator said.<\/p>\n
NIA chief Sharad Kumar refused to comment on the development when contacted by Hindustan Times.<\/p>\n
Three people, including two BSF troopers, were killed and 11 others were injured after Naveed and his accomplice Noman opened fire on a BSF bus on the Jammu-Srinagar National highway on August 5.<\/p>\n
After escaping from the attack site, the accused had entered Chirdi village near Samroli on the highway and taken three people hostage. He was finally over-powered by his hostages and handed over to the police.<\/p>\n
